Terms of Service

These Terms & Conditions apply to all photography services (hereafter referred to as "the Service") offered through Potonow. By purchasing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Potonow reserves the right to update these Terms at any time. Continued use of the Service after any updates means you accept the revised Terms.

1. PHOTOGRAPHY SERVICE

  • The session includes meeting at the designated location and photographing at the reserved location.
  • The shooting time includes travel between shooting spots, selecting locations, setup, and pack-up.
  • The photographer will be assigned by Potonow and may be changed if necessary.
  • All original photos will be delivered within 03 days after the photoshoot.
  • Edited photos will be delivered via a designated Google Drive link within 07 days after the photoshoot.

2. CANCELLATION POLICY

  • Booking Fee is non-refundable under any circumstances if the Customer cancels the service.

  • If the Customer has paid 100% of the Total Service Fee:

    • Cancellation at least 07 working days in advance: 100% of the Total Service Fee will be refunded, less any bank transfer fees (if applicable).
    • Cancellation between 03 and 06 working days in advance: 50% of the Total Service Fee will be refunded, less any bank transfer fees (if applicable).
    • Cancellation within 48 hours or Last-minute cancellation: Non-refundable.

  • Booking Changes:

    • Once your booking is confirmed, changes are not allowed unless approved by Potonow.
    • Any agreement made directly between the Customer and the Photographer is not considered an official booking change unless confirmed by Potonow.
    • If the photographer is unable to attend the scheduled session or the photoshoot cannot proceed due to force majeure (such as severe weather or other safety concerns), Potonow will assist in arranging a reschedule or provide an appropriate solution.

3. HEALTH DISCLAIMER & LIMITATION OF LIABILITY

  • The Customer shall be solely responsible for ensuring that they are in good physical and mental health condition prior to and throughout the course of using Potonow's services.
  • To the maximum extent permitted by applicable law, Potonow shall be fully exempted from any and all liabilities for any damages, injuries, or health issues incurred by the Customer, except where such issues are proven to be directly and willfully caused by Potonow's fault.

4. DATA PRIVACY & IMAGE RIGHTS

  • By booking the Service, you agree that Potonow may collect, use, and process your personal information (such as your name, contact details, payment information, and other necessary information) for service delivery, payment processing, legal compliance, and internal operations, in accordance with applicable data protection laws and Potonow's Privacy Policy.
  • To provide the Service, Potonow may share the information necessary for the photoshoot (such as your name and contact details) with the assigned photographer.
  • Unless you request otherwise before the photoshoot, you agree that Potonow may use selected photos from your session for our portfolio, website, social media, and other marketing materials. If you prefer to keep your photos private, please notify us before the photoshoot.

5. OTHER NOTES

  • If you arrive late, the photoshoot will still end at the original scheduled time.
  • The final number of delivered photos may vary depending on the shooting conditions.
  • Any transportation fees, entrance tickets, or other expenses required during the photoshoot are the Customer's responsibility, including the Photographer's costs where applicable.
  • Bookings must be made through Potonow. Customers and Photographers may not arrange or complete future bookings directly outside the platform.
  • Photos are edited according to the Photographer's artistic style. Requests for re-editing or complaints regarding personal preferences (such as composition, angle, lighting, or color tone) may not be accepted.
  • Potonow is not responsible for delays or cancellations caused by circumstances beyond our reasonable control, including severe weather, natural disasters, transportation disruptions, or other force majeure events.
  • To the maximum extent permitted by applicable law, Potonow's liability for any claim relating to the Service is limited to the amount paid for the booking.
